Third Circuit Hears Oral Argument in Griswold v. Coventry First

On January 14, 2014, the Third Circuit Court of Appeals heard oral argument on Coventry's appeal of the rulings of the Eastern District of Pennsylvania, which denied Coventry's motion to dismiss and to compel arbitration. TPG represents the plaintiff and proposed plaintiff class.  
The appellate panel consisted of Judges Thomas L. Ambro, Thomas M. Hardiman, and Joseph A. Greenaway Jr.  At argument, the Court focused on three areas of inquiry: (1) standing; (2) applicability of arbitration provisions to nonsignatories; and (3) the suitability of class arbitration.  It is unknown when the Court will render its decision.
