The U.S. Department of Justice (DOJ) recently issued a press release reporting another record-breaking year for judgments and settlements in civil cases involving fraud and abuse, particularly qui tam whistleblower actions under the False Claims Act (FCA). The DOJ reported that recoveries of a staggering $5.69 billion in the 2014 fiscal year. Medicare, Medicaid, and other federal health care fraud claims under the FCA led to the recovery of $2.3 billion alone.
According to DOJ, a "substantial" portion of these recoveries arose from pharmaceutical industry companies. However, hospitals, home health providers, device manufacturers, and other health care providers also accounted for a significant portion of the $2.3 billion. For example, the government recovered $333 million from hospitals in FFY 2014.
The press release attributes the government's record-breaking recoveries to reasons including the actions of qui tam whistleblowers. Nearly $3 billion of the government's 2014 recoveries were attributable to FCA qui tam lawsuits.
All evidence suggests that these trends will continue. For example, in 2014, move than 700 additional FCA whistleblower lawsuits were filed under the FCA, marking the second consecutive year of such numbers.
